The proces after reporting

When you have reported an invention or shared an idea with the business developers in SDU RIO, your information is treated confidentially.

Based on your information, we assess the invention or idea and analyse the  market and existing technologies.

We talk to you about your research plans and your own view of the potential and how you want to be involved in any commercialisation process.

All to determine the commercial potential. 

Novelty requirement: An invention can only be patented if it is new. Therefore, it is important that you do not publish or disclose the invention before the assessment is completed.

Two-month evaluation period: You must not publish or exploit the invention for up to two months from the date of disclosure, cf. § 11, subsection 2.

SDU’s decision: No later than two months after receiving your disclosure, SDU will inform you whether the university wishes to take over the rights to the invention, cf. § 8, subsection 1.

SDU takes over the rights: If SDU decides to take over the rights, you are entitled to reasonable compensation, cf. § 12, subsection 1.

SDU does not take over the rights: You retain the rights, but SDU may be entitled to compensation if you later exploit the invention commercially, cf. § 12, subsection 2.

If you later achieve results that strengthen the potential of the invention, you are welcome to contact SDU RIO again.

To ensure the best possible assessment and protection of your invention, we recommend that you contact us at least one month before any planned publication.
