About annual leave and maternity/paternity leave

In general

You are not allowed to take your annual leave while on maternity/paternity leave and adoption leave (holiday obstacle).

You will not forfeit your right to take annual leave, but depending on what time of year you are on/end your leave of absence, you will have to take your annual leave at a later date in the holiday period, have your holiday allowance paid out, or enter into an agreement with your department/unit to transfer your annual leave to the next holiday period. The agreement is then forwarded to Vivi Madsen, Human Resource services.

If you are prevented from taking your annual leave for the entire holiday period (1 September to 31 December of the following year), the 1st to 4th holiday week is automatically transferred to the next holiday period. If your leave of absence ends before the end of the holiday period (31 December), you can take your annual leave in the period from the end of your leave of absence until 31 December. Therefore, your annual leave is not transferred if you had the opportunity, in whole or in part, to take it before 31 December (any annual leave not taken will be forfeited). It is therefore important that you plan your annual leave in connection with returning from leave of absence as soon as possible.

The 5th holiday week is only transferred following an agreement.

If you have partially resumed work and are working full-time days, you can take your annual leave on the days that you are working. The general rules of taking remaining holiday entitlement therefore apply to these days.

Accrual of holiday

You earn paid annual leave and special holidays during paid pregnancy, maternity, paternity, parental and adoption leave as well as leave of absence for registered partners. You also earn paid holidays and special holidays during unpaid leave, where pension is paid by your employer.

During unpaid periods of leave where your employer is not paying pension, you do not accrue paid annual leave and special holidays.

If you are paid monthly and covered by the state's holiday agreement, you will still earn paid annual leave and special holidays for the first 6 months of an unpaid period of leave without pension paid by the employer. However, it is a prerequisite that you 1) resume work before the end of the holiday year in which the annual leave/the special holidays must be taken, and that 2) the annual leave/the special holidays are taken before the end of the holiday year in question, unless the annual leave/the special holidays are postponed in accordance with the Holiday Act's special legislative measures for prevented annual leave, transfer of or postponement of annual leave.

If the conditions are not met, the days of annual leave/special holidays will be forfeited.
